Permanent Washington is wargaming January 3, 2027, and the referee is already picking sides. Former Democratic House Leader Dick Gephardt tells the Daily Beast that groups like his Keep Our Republic are preparing for a "blown election" and constitutional crisis — treating any Republican challenge to certification as an existential threat rather than a legal process available to both parties.
The Daily Beast framed Trump's rhetoric about a "final battle" as a near-certain prelude to dictatorship, but what's actually happening is more telling: the same institutional class that spent decades running Washington is now building legal and protest infrastructure to ensure no outcome they dislike survives contact with the certification process.
Trump released a black-and-white video declaring "this is the final battle" and vowing to "throw off the sick political class" and "rout the fake news media." The Daily Beast interprets this as proof he'll refuse to accept any loss. Gephardt takes it further, suggesting Speaker Mike Johnson could fire the Clerk of the House and install a loyalist who refuses to seat contested Members-elect — a scenario for which KOR and groups like Democracy Forward and the Brennan Center are preparing legal challenges and, failing that, street action.
"If that happens, we're prepared to file lawsuits, and if they don't succeed, then all that's left is to hit the bricks," Gephardt told the Daily Beast.
Gephardt served nearly 30 years in Congress, was House Majority Leader from 1989 to 1995, ran for president twice and lost, then founded a labor relations consulting firm. Now he leads an outfit billing itself as "nonpartisan" while wargaming exclusively against one party's potential moves. The Daily Beast calls him "not given to histrionics" — a generous read of a man predicting constitutional collapse from a candidate who hasn't yet taken office.
Meanwhile, the Supreme Court allowed states to access Social Security data compiled through Elon Musk's DOGE initiative to screen for illegal voting. The Daily Beast frames this as the Court "bowing to Trump again" — casting election integrity measures as inherently illegitimate rather than as the kind of citizen verification the Founders would have assumed essential to self-government.
Gephardt's demand for "Mike Pences at the state, local and federal level" is the tell. What he means is: Republicans who will certify outcomes regardless of whether irregularities exist. That's not democracy. That's a rubber stamp — and the establishment is organizing to protect it.
The open question is whether either party will ever again accept an election it loses, or whether the real "final battle" is the one Americans have already lost: the belief that their vote means something beyond theatre.
