A Minnesota prosecutor funded by George Soros is charging journalists James O'Keefe and Cam Higby with felonies carrying up to five years in prison each — for walking into polling places, asking questions, and exposing how the state lets strangers vouch for eight unregistered voters with no ID. No fraudulent ballot was ever cast. No affidavit was ever signed. The crime was embarrassing the people in charge.

Hennepin County Attorney Mary Moriarty announced felony charges of unlawful voting and identity theft against both men Wednesday. The charges stem from an August undercover video in which O'Keefe and Higby entered Minneapolis polling locations during the state's primary wearing Islamic garb and recorded poll workers explaining Minnesota's vouching provision. Under that law, a single registered voter can vouch for up to eight unregistered people in the same precinct, serving as their identification. "You're the ID," one poll worker told O'Keefe on camera.

Moriarty concedes the men never signed polling-place oaths, never obtained ballots, and never voted. Her office argues they "intentionally misrepresented their identities in applying for ballots" by giving election judges the names of registered voters — including, Moriarty said, some who were deceased — without those voters' knowledge. Higby responded: "No laws were broken. They want me in PRISON for exposing election vulnerabilities in their state."

The Guardian framed the defendants as "rightwing influencers" and described O'Keefe as founder of a "discredited rightwing attack organization," while The Post Millennial and HotAir described them as journalists. The Guardian also noted that vouching was used for less than 0.6% of votes in the 2024 general and that vouchers must sign affidavits under penalty of perjury — safeguards the journalists themselves never triggered, since they never signed anything.

What the establishment press buries: Moriarty's record on actual crime. The Daily Caller reported that Moriarty has faced criticism from members of her own party — including Democratic Attorney General Keith Ellison and Democratic Governor Tim Walz — over her handling of the 2023 Zaria McKeever murder case. Moriarty offered juvenile plea deals amounting to roughly two years in a correctional facility for the teenage brothers who carried out the killing, deals the victim's family opposed as inadequate. HotAir characterized the charging pattern bluntly: violent criminals walk; journalists who embarrass Democrats get the book thrown at them.

Minnesota Secretary of State Steve Simon backed the prosecution, saying polling places are "the heart of our democracy" and that "any attempt to disrupt or deceive our election workers will not be tolerated." Moriarty added that undercover journalism has no place at a polling location: "If you identify as a journalist, there is no such thing as undercover investigation in the polling place."

That claim — that the press must identify itself to the state before investigating the state — is the real stake here. If prosecutors can stretch "unlawful voting" to cover journalists who never voted, every reporter who goes undercover to document how elections actually run is one creative prosecutor away from a felony charge. The vouching system O'Keefe and Higby exposed is still in place. The question is whether the people who exposed it will be the only ones punished.
