Big Tech is moving its data centers to space after Americans ran them out of their backyards — and once those servers are in orbit, accountability drops to near zero.
The story is straightforward: communities across the South and Midwest got tired of massive server farms sucking up land and power, and lawmakers started listening. Governors and state legislators pushed moratoriums and tougher rules on data center construction. Now the tech giants want to literally rise above the problem — and the regulation.
Elon Musk's SpaceX is leading the charge. The company filed with the Federal Communications Commission to launch as many as one million satellites for orbital AI processing, according to FCC documents. Musk announced in August that Nvidia designed a "space-optimized" AI chip set to launch in the fourth quarter of 2027, calling the design "significantly simpler, lower cost, denser and lighter than a traditional rack." SpaceX says it will use Nvidia's technology for these orbital data centers.
And SpaceX isn't alone. The Daily Caller reported that startup Cowboy Space filed for a 20,000-satellite system it calls the "Stampede Data Center System." Starcloud asked the FCC for up to 80,000 orbital data center satellites. Amazon's Blue Origin wants up to 51,600. Another startup, Orbital, applied to deploy as many as 100,000. Google announced Project Suncatcher in November 2025, planning to launch solar-powered satellite prototypes in early 2027.
That's potentially over 1.2 million satellites from these applicants alone.
Kristian Stout, director of innovation policy at the International Center for Law & Economics, told the Daily Caller that AI labs face growing pressure to explore orbital data centers "due to Americans' dislike of their presence in their communities." He added: "We are going to need more data centers in more places."
The FCC, for its part, is rolling out the red carpet. A commission spokesperson told the Daily Caller that under President Trump, the FCC is moving quickly to ensure the United States leads in "the orbital infrastructure of tomorrow." The pending applications suggest the agency sees its role as facilitator, not watchdog.
China isn't waiting. ADA Space and Zhejiang Lab launched the first 12 satellites of a planned 2,800-satellite orbital network in 2025, according to Space News. Multiple Chinese firms — China Mobile, Bailing Aerospace, Shanghai Xingshu Space Technology — plan their own orbital data centers. The European Space Policy Institute warned in August that Europe may fall behind.
So the race is on. But here's the question nobody in Washington seems eager to answer: what laws govern a data center orbiting 300 miles above American soil? Who audits the algorithms running on servers no inspector can visit? What happens to your data when the physical hardware is, by design, untouchable?
Americans pushed data centers out of their communities for a reason — noise, power consumption, land use, lack of transparency. Moving those same operations beyond the atmosphere doesn't solve the accountability problem. It escapes it.
The FCC is approving launches. The companies are spending billions. China is already up there. Nobody is asking what oversight looks like when the server room is in low Earth orbit.
