A House Judiciary Committee report confirms that Soros-backed Fairfax County prosecutor Steve Descano shielded more than 100 illegal alien criminals from deportation while the county sheriff ignored 1,670 federal detention requests — a deliberate strategy that has already cost American lives.
This isn't bureaucratic incompetence. It's policy. Sanctuary jurisdictions don't happen by accident — they happen because elected officials, funded by activist networks, choose foreign nationals over the citizens they're sworn to protect. Fairfax County is the proof.
The committee, chaired by Jim Jordan, reviewed more than 1,100 criminal cases and found that Descano "routinely fails to prosecute or under-prosecutes criminal aliens" and has "de facto decriminalized numerous offenses in his jurisdiction." The result: over 100 previously unreported illegal immigrants benefited from his repeated refusal to prosecute.
According to the report, Descano's office rarely pursued charges against illegal immigrants arrested for DUI, felony drug possession, felony grand larceny, shoplifting, fraud, trespassing, destruction of property, and assault on a law enforcement officer. In one case, Descano dropped more than 50 charges against a serial fraudster from China. Multiple aliens charged with malicious wounding, strangulation, and assault and battery walked free and reoffended.
Fox News reported that the committee accused Descano of treating illegal immigrant defendants "differently from similarly situated American citizens to limit their immigration consequences" — meaning foreign nationals got special treatment to keep them from being deported. American citizens face the full weight of the law; illegal aliens get a shield.
Meanwhile, Fairfax County Sheriff Stacey Kincaid refused to honor at least 1,670 ICE detainers between 2023 and 2025, releasing criminal aliens back onto northern Virginia streets instead of transferring them to federal custody. The report states that in most cases reviewed, the criminal aliens reoffended — "even escalating their criminal behavior to violent offenses and even murder."
The report also alleges Descano misled Congress. During May testimony, Descano claimed his policy was "written with legal permanent residents in mind" — but the evidence shows it's been applied far more broadly to shield illegal aliens.
Follow the money. Fox News identifies Descano as a "Soros-backed" prosecutor — part of the network of district attorneys bankrolled by George Soros's activist funding machine. These prosecutors don't materialize from grassroots demand; they're installed with outside cash to dismantle enforcement from the inside. The Biden-Harris administration greased the skids: the report notes that beginning in April 2021, the Justice Department no longer required jurisdictions to cooperate with ICE as a condition of receiving federal grant funding. Your tax dollars fund the jurisdictions that undermine federal law.
The report frames Fairfax not as an outlier but as emblematic: "They are indicative of a modern, radical, socialist Democrat Party that seeks to erase national borders and place illegal alien criminals ahead of law-abiding American citizens." WJLA reported that both Descano and Kincaid were contacted for comment. Neither has responded.
The question isn't whether sanctuary policies endanger Americans — the body count answers that. The question is who keeps funding the officials who implement them, and when the public stops paying the bill.
