An illegal immigrant from Honduras charged with multiple child sex crimes was released back onto the streets by Fairfax County, Virginia, after local authorities refused to honor an ICE detainer — and federal agents had to go hunt him down themselves.

Oscar Evaristo Nunez was initially arrested Aug. 27, 2025, on charges of aggravated sexual battery involving children, two counts of aggravated sexual battery of a victim under 13, and two counts of filming an undressed minor without consent, according to the Department of Homeland Security. ICE lodged a detainer with the Fairfax County Adult Detention Center two days later. The county ignored it and let Nunez walk without telling federal authorities.

ICE finally re-arrested Nunez on Sept. 15 during a targeted enforcement operation. He remains in federal custody pending immigration proceedings.

DHS Secretary Markwayne Mullin didn't mince words:
